The darned spindle and caliper bracket are not perfectly aligned to each other, it also scored a part of the rotor.
So I put in a shim in between the two (top and bottom), and it appears to have the proper clearance now, and now the whole brake assembly seems to go properly in place. Yay me.

FYI this sort of misalignment is rare these days. Usually the caliper is faulty which isn't common in OEM parts. If the shim doesn't fix it opt for a reman caliper.

Will do, but the misalignment isn't at the caliper from what I've seen

Yeah, what pfftballer said. What kind of car is it? Some older cars do use shims to adjust caliper spacing, but in most cases this means the caliper or mounting is somehow bent or compromised.

The spindle was bent slightly out of shape.
